Public agreement to order paid services

This agreement is a formal and public offer by the website owner (the Vendor) to enter into a contract to order paid services. A list of available fee-based services and prices can be found at: https://yonfi.com/advertise.html . This contract is public, i.e., according to Article 633 of the Civil Code of Ukraine, its conditions are the same for all regardless of their status (natural person, legal entity, natural person-entrepreneur) without preference for one user over another. By entering into this Agreement, the website user (Buyer) fully accepts the terms and conditions of the ordering of paid services, liability for non-compliant ordering, and all other terms and conditions of the agreement. The contract is deemed to have been concluded when the Buyer tops up the balance and the Seller receives confirmation of the order electronically.

 

1.1 Public Offer (hereinafter referred to as the "Offer") is a public offer by the Seller, addressed to an indefinite number of persons, to conclude with the Seller an agreement on provision of paid services by remote means (hereinafter referred to as the "Agreement") on terms and conditions contained in the Offer.

1.2 Service - the object of the parties' agreement, which the Buyer has selected on the website.

1.3 Website - Seller's website at https://yonfi.com/.

1.4 The Buyer is a legally capable natural person of 18 years of age or older who receives information from the Seller and orders the paid services of the website.

 

2.1 The Seller shall provide the services chosen by the Buyer.

2.2 The date of the offer agreement (acceptance of the offer) and the date of the Buyer's full and unconditional acceptance of the terms and conditions of the agreement shall be the date of the Buyer's top-up on the website.

 

3.1 The Buyer shall independently choose the paid services available on the website. The complete list of paid services shall be available to the Buyer at the address: https://yonfi.com/advertise.html .

3.2 Seller has the right to refuse to provide paid services to the Buyer if the advertisement to which the paid services apply violates the rules of the website: https://yonfi.com/terms.html

3.3 By concluding the Contract, i.e., accepting the terms of this offer by placing an Order, the Buyer confirms the following

a) The buyer is fully aware of and agrees to the terms of this offer;

b) It authorizes the collection, processing, and transfer of personal data, the authorization to process personal data is valid for the duration of the Contract and for an indefinite period after its expiry. Furthermore, by concluding the Contract, the Buyer confirms that he is notified (without further notice) of the rights established by the Law of Ukraine "On Protection of Personal Data". The scope of the Buyer's rights as a subject of personal data in accordance with the Personal Data Protection Act of Ukraine is known to him and understood.

 

4.1 The prices of the services are determined by the Seller and are indicated on the website: https://yonfi.com/advertise.html.

4.2 The Seller may unilaterally change the prices of the services according to market conditions. However, the price of individual service, the price of which has been paid in full by the Buyer, may not be unilaterally changed by the Seller.

4.3 The Buyer's obligation to pay for the Service shall be deemed to have been fulfilled from the moment the Seller receives the money on its account.

4.4 Payments between the Seller and the Buyer for the Service provided shall be made by the methods specified on the website.

 

5.1 The seller shall:

5.1.1 Provide the Services to the Buyer in accordance with the terms of this Agreement at the Buyer's request.

5.1.2 Not to disclose any private information about the Buyer and not to make this information available to third parties, except as required by law and in the performance of the Buyer's Order.

5.2 The seller has the right:

5.2.1 Amend the terms and conditions of this Agreement, as well as the prices of the Services, unilaterally by posting them on the website. All changes shall take effect as of the date of publication.

5.3 The buyer undertakes:

5.3.1 Before concluding the Agreement, read the contents of the Agreement, the terms, and conditions of the Agreement, and the prices offered by the Seller on the website.

 

6.1 Refund will be made if you secede to cancel our services within 3 days of making the payment.

6.2 Refunds will be returned by the means that payment was made.

6.3 Amount of refund will be credited in the account from which the payment was made within 30 days of service cancellation.

 

7.1 The Seller and the Buyer shall be liable for the performance of their obligations in accordance with the current legislation of Ukraine and the provisions of this Agreement.

7.2 The Seller or the Buyer shall be released from liability for full or partial non-performance of their obligations if the non-performance is due to force majeure circumstances such as war or warlike actions, earthquake, flood, fire, and other natural disasters, which have occurred independently of the will of the Seller and/or the Buyer after the conclusion of this contract. The Party that is in a position to fulfil its obligations shall notify the other Party immediately.

 

8.1. By providing his personal data on the website https://yonfi.com/ when registering or placing an Order, the Buyer gives the Seller his voluntary consent to process, use (including transfer) his personal data, as well as perform other actions provided by the Law of Ukraine on Personal Data Protection, without limitation of duration of such consent.

8.2 The Seller shall not disclose any information received from the Buyer. It shall not be considered a breach of Seller's duty to provide information to counterparties and third parties acting on the basis of a contract with the Seller, including in order to fulfil obligations to the Buyer, as well as in cases where disclosure of such information is required by the applicable laws of Ukraine.

8.3 The Buyer shall be responsible for keeping the personal data up to date. The Seller shall not be liable for poor performance or failure to fulfil its obligations due to the fact that the Buyer's information is not up-to-date or does not correspond to its validity.

 

9.1 This contract is concluded in the territory of Ukraine and shall be governed by the laws of Ukraine in force.

9.2 All disputes arising between the Buyer and the Seller shall be resolved through negotiations. If the dispute is not resolved by negotiation, the Buyer and/or the Seller shall be entitled to apply for the resolution of the dispute to the courts in accordance with the laws of Ukraine in force.

9.3 The Seller is entitled to amend this Agreement unilaterally in accordance with clause 5.2.1. of the Agreement. In addition, the Agreement may be amended by mutual agreement of the Parties in accordance with the procedure stipulated in the current legislation of Ukraine.
